The closing process generally begins with a written contract of sale. This document is negotiated between the lawyer for the seller and the lawyer for the buyer. When this document has been signed, the parties will start to line up the details, resolve issues and prepare the proper documentation for the closing.

Numerous entities have to be satisfied in order for the closing to be completed successfully. Some of these include:

  • A bank offering financing
  • A title company offering title insurance
  • New York state, counties, municipalities and school districts requiring fees and taxes
  • Lenders holding prior mortgages on the property
  • Parties who hold a judgment against the seller
  • Parties who contributed to the closing process such as inspectors, appraisers and brokers

Right before the closing, adjustments will need to be made to compute the prorated property taxes, oil in a tank on the property and other costs that shift from the buyer to the seller. These adjustments often lead to a flurry of activity immediately before the closing and can put a strain on buyers and sellers.
