Man facing second drunk driving charge

A New York man was facing felony charges after he was accused of driving while intoxicated on Oct. 7. The accused man, age 30, reportedly had one previous conviction for drunk driving.

Troopers initiated a traffic stop at about 10:45 p.m. on Seymour Street after the man reportedly failed to use his turn signal. It also appeared that his vehicle was missing its front licence plate. Troopers determined that the man had a blood alcohol content of .11 percent. As such, he was taken into custody.

He was ultimately charged with felony DWI and felony operating a vehicle with a blood alcohol content level of at least .08 percent. He was also charged with several traffic violations, including drinking alcohol while driving on the highway, failing to use a turn signal, unsafe turning and failing to have a license plate on the front of the vehicle. He was released and was scheduled to return to court on Oct. 13 at 9:30 a.m.

When people are charged with drunk driving, even the accusations can have a major impact on their life. It is likely that they could have their license suspended before the criminal trial ever takes place. Further, if they are convicted during the criminal trial, the consequences could include a jail sentence, especially if they have a prior conviction. A criminal law attorney could help defendants keep their driver’s license, especially if it is needed for work. When it comes to the trial, the attorney may try to find flaws in the case or negotiate with the prosecution.
