New York motorists may be interested to hear that several companies are releasing commercial breathalyzer devices for motorists. While many hope that these devices will keep drunk drivers off of the road, others fear that motorists may use them to avoid being arrested for DWI by drinking just enough to still be under the legal limit.

Police in New York often cast a very wide net when cracking down on drunk driving during major holidays such as this past Labor Day. Such a broad search is likely to return false positives due to the nature of field sobriety testing. Repercussions for those charged with DUI or DWI can include the loss of their driver's licenses and major increases in insurance costs.

Fourth Amendment rights and field sobriety tests questioned

A recent decision from a federal appeals court in another state might be of interest to our readers here in Poughkeepsie, New York. The court decided that a woman could pursue her case against a state trooper who stopped her, conducted field sobriety tests and then arrested her for drunk driving. Urine tests proved that she was not under the influence of any drugs or alcohol of any kind.

If police believe you are under the influence of prescription drugs or narcotics they can still conduct a battery of tests to determine your ability to drive and arrest you for Driving While Ability Impaired or DWAI.
