2 drivers face DWI, other charges following crash in New York

Two men are facing DWI and other charges following an accident in Bellmore on Nov. 18. According to reports, a 25-year-old woman was seriously injured in the crash, which happened on Bellmore Avenue at approximately 4:32 a.m. Preliminary reports indicate that one man was expected to be arraigned in the First District Court in Hempstead on Nov. 19. The other offender remained hospitalized with multiple facial lacerations.

The accident occurred in the vicinity of Marion Street when a northbound 2006 Nissan driven by a 27-year-old man hit a legally parked 2002 Chevy. A 30-year-old man, who reportedly knew the driver of the Nissan and was following that car in a 2017 Volkswagen, stopped his vehicle at the scene and offered assistance. When police arrived, they found the critically injured woman, who had been traveling in the Nissan, lying in the front seat of the Volkswagen. Both drivers were standing near that car.

Following an investigation, police alleged that both drivers were under the influence and that the older man was in possession of marijuana and cocaine. Charges against the driver of the Volkswagen include DWI (prior conviction within 10 years), criminal possession of a controlled substance and unlawful possession of marijuana. The driver of the Nissan was charged with DWI, second-degree vehicular assault, second-degree assault and second-degree reckless endangerment.

In New York State, drunk driving is a serious offense that can carry harsh consequences upon conviction. Individuals who find themselves facing DWI charges following an accident may find it beneficial to retain legal counsel. Depending on the facts of the incident, the attorney might be able to successfully challenge the prosecution's evidence, which could ultimately lead to a case dismissal.
