New York fatal accident leads to DWI charges

A pedestrian was killed while delivering the Sunday paper in Hampton Bays on Jan. 05. While she was standing outside of her car, a drunk motorist hit her as well as two other parked cars located nearby. The delivery woman was pronounced dead on the scene.

The driver of the car was initially charged with a DWI. The charges could be upgraded pending the rest of the police investigation. Currently, the authorities are still looking for witnesses and any other information that could shed more light on the exact events that lead to the crash and the pedestrian death. The investigation is being led by local and state police and forensic experts.

It is unclear if the accused person in the case has a prior criminal record. Authorities would only say that this was the first time that this driver had been arrested for a DWI. It is also unclear when the driver would be back in court or who was representing him.

For a DWI first offense, a driver can expect to face a fine, a license suspension and possible jail time. However, a DWI case is not as open and shut as it sounds. If the evidence was tampered with or not collected properly, a judge or prosecutor may have no choice other than to drop the charge.
