Acquittal at trial can save your driver's license from revocation. While your trial is pending, however, you may be able to seek a hardship license. Additionally, if you are convicted, it may be possible to secure a conditional license to drive to work, school and medical appointments.

Hardship Licenses
If you are charged with DWI and there is a certified breath test result at the arraignment, license suspension is mandatory. However, you may be able to secure a hardship license at arraignment if you meet the following criteria:
- You have not had a conditional license within the past five years
- You can show that there is a hardship if your license is suspended pending prosecution
A common example of a hardship would be a lack of public transportation between your home and work. A hardship license will permit you to drive to and from work, school and/or medical appointments. It is valid for only certain times of day and for limited time periods.
Conviction, 20-Day Stay and Conditional Licenses
If you are convicted for DWI or another alcohol-related offense, I can request a 20-day stay of the suspension or revocation that the court will impose at the time of sentence. This will give you a temporary license for 20 days. After the completion of the 20-day stay, you can request a conditional license.
Similar to a hardship license, a conditional license is granted only if:
- You have not had a previous conditional license in the last five years
- You sign up for the drinking driver program (DDP)
- You pay the appropriate fees
Upon successful completion of the drinking driver program the Department of Motor Vehicles (DMV) might cut short the suspension or revocation period. To get a conditional license, you do not need to demonstrate hardship.
