Poughkeepsie Lawyer Handling Aggravated DWI Defense

While being arrested for drunk driving never bodes well for anyone in the Hudson Valley, being charged with aggravated DWI is even worse. It comes with harsher financial penalties and you could lose your driver's license for at least a year, lose your car registration, be on probation, and you will have to install and maintain an ignition interlock device. If you're facing aggravated DWI charges, you can't afford to be without an experienced DWI defense attorney.

How Is Aggravated DWI Different From DWI?

Aggravated DWI occurs when you have .18 per centum or more blood alcohol content. DWI occurs when you have .08 per centum or more blood alcohol content. On a first offense for aggravated DWI, you could be fined a minimum of $1,000 up to $2,500, a mandatory license revocation of at least one year, probation for three years and the requirement of installing an ignition interlock device in your vehicle. On a first offense for DWI, you face a fine of between $500 and $1,000 and a mandatory license revocation of at least six months and the requirement of installing an ignition interlock device on your vehicle. These and other issues can be discussed in a consultation. For further explanation on the penalties, please visit the page on DWI, DUI, DWAI and aggravated DWI penalties.

Your Choices After an Arrest for Aggravated DWI

After your aggravated DWI arrest, you have two choices: trial or plea. You can try to limit your damage by negotiating a plea bargain or you can take your case to trial. In some cases, it can be beneficial to negotiate a plea bargain in order to reduce the charge from aggravated DWI to DWI, which will reduce the fines you face. I will advise you of your options. The choice is yours.
